Our client worked in the manufacturing industry for several years, specifically from 1988 to 1993, in a Gold Shaft department. Throughout his employment, our client worked over 40 hours per week, frequently completing overtime shifts, with only short daily breaks of 30 to 60 minutes. He was employed as a setter and machine operative and worked in an excessively noisy environment, constantly exposed to the loud operation of foundry machinery used for loading and unloading gold shaft components.
The machinery operated throughout the day and was positioned near where our client worked, both personally and among his colleagues. The noise levels were so severe that verbal communication required shouting, even between individuals just a few feet apart. Crucially, during his time at the company, no hearing protection was provided, nor was our client given any training, supervision, or information regarding the risks associated with prolonged noise exposure. No noise or risk assessments were carried out or reviewed by the employer, despite the obvious and foreseeable risk of injury.
Over time, our client developed progressive hearing loss and tinnitus, describing a constant ringing in his ears that disturbed his sleep and affected his ability to engage in everyday conversations, particularly in noisy or social environments.
